DeLadurantey Law Office Files Lawsuit Against Florida Credit Repair Firm; Suit Alleges Idaho Man Defrauded in Credit Repair Scheme

MILWAUKEE, Oct. 23, 2014 /PRNewswire/ — DeLadurantey Law Office has filed a lawsuit in the U.S. District Court, Southern District of Florida on behalf of Anthony Bryson Sr., of Weippe, Idaho, alleging that he was a victim of a credit repair scheme by the Ft. Lauderdale, Florida law firm of Berges Law Group and its affiliated companies.

In the complaint filed on October 9, 2014, the defendants — Otto Berges; Berges Law Group, P.A.; Consumer Protection Counsel, P.A.; Debt Be Gone LLC and its owner Greg Fishman – are charged with violating several provisions of the Credit Repair Organizations Act (CROA).

"Mr. Bryson has unfortunately fallen victim to a credit repair scheme that preyed upon his debt problems with empty promises," said Nathan DeLadurantey, managing partner of DeLadurantey Law Office, a Milwaukee consumer protection law firm.  "He has paid for services not rendered, and those services were not properly communicated to him, which is a violation of federal law."

The suit states that the defendants contacted Bryson in April 2014 via email with multiple offers to help him.  He eventually applied for these services and was emailed a contract from defendant Consumer Protection Counsel, although Bryson thought that he would be working with Debt Be Gone, LLC.

The email also included an agreement for Bryson to consent to ACH withdrawals for a monthly fee to defendants regardless if the defendants performed services that month.

According to the complaint, the contract did not state a guarantee of performance, did not state an estimate by which the performance will be complete (only the amount of time for which he would pay), did not state an estimate of the length of time necessary to perform the service, did not state the credit repair organizations' principal business address, and did not state the statutory language regarding Bryson's right to cancel the contract.   All of these exclusions are in violation of the CROA.

The October 9 complaint filed by DeLadurantey requests a jury trial seeking actual and punitive damages as well as costs and attorney's fees.
