Student Housing Apartment Infested with Bed Bugs

Bed Bug Attorney Files Suit Over Bed Bug Infestation Against Student Housing Complex For USF Students

TAMPA, Fla., March 4, 2014 /PRNewswire/ — Nationwide bed bug lawyer Craig Dell filed suit against Campus Advantage, Inc. and CCAL 4050 Rocky Circle Road LLC.  The lawsuit alleges that employees and management took ineffective actions in detecting and treating a bedbug infestation at one of their properties known as 4050 Lofts- a 196-unit, 722-bed off-campus apartment community for students attending the University of South Florida and Hillsborough Community College in Tampa, Florida. Campus Advantage also manages the Campus Lodge in Tampa, which houses University of South Florida students and 42 other nationwide off-campus housing locations totaling more than 25,000 beds.

The lawsuit filed on January 30, 2014 in Hillsborough County Circuit Court, Florida by bed bug attorney Craig Dell on behalf of a resident of 4050 Lofts, claims that his apartment was infested with bed bugs. Additionally, the lawsuit alleges 4050 Lofts violated Florida's Deceptive and Unfair Trade Practices Act and seeks to enjoin 4050 Lofts from renting apartments which are not safe for human occupancy. The former resident seeks damages for more than one hundred painful and intensely itchy bed bug bites, bodily injury, pain and suffering, mental anguish, and economic loss.

"It is apparent that something needs to be done and a solid effort needs to be launched to preclude property owners and management companies from renting units known to be infested with bed bugs. The jurors of Hillsborough County, Florida and other counties throughout the state will continue to see case after case until new laws are put in place preventing landlords from failing to disclose bed bug related information to prospective tenants," said plaintiff's attorney Craig Dell.

Within less than a month of taking possession of his apartment at 4050 Lofts, the Hillsborough County Code Enforcement conducted an inspection of the apartment and found 4050 Lofts in violation of Hillsborough County Property Maintenance Code, Section 11.8.2. The lawsuit asserts 4050 Lofts received notice of the bed bug problem before the Plaintiff took possession of his unit and received continued complaints from other 4050 Lofts' tenants referencing bed bugs up through the termination of Plaintiff's lease.  If a bed bug Infestation occurs in one unit, it is common practice that frequent inspections of the neighboring units, on all sides, be conducted until the bed bug problem has been abolished and the units have been determined to be safe for human occupancy.
